These Terms & Conditions ("Terms") govern your access to and use of FrightSpot (the "Service"), operated by FrightSpot LLC ("FrightSpot", "we", "us"). By accessing or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who you are contracting with
You are entering into an agreement with FrightSpot LLC. If you accept these Terms on behalf of a business or organization, you confirm you have authority to bind that organization. If you use the Service as an individual, you confirm you are of legal age in your jurisdiction. Certain community features (FrightPack membership, ratings, comments, RSVPs) require you to be 18 or older.
The Service
FrightSpot is a directory of haunts, Halloween and horror-adjacent events, and spooky retail locations. Anyone may browse and search listings for free. Listing owners may submit haunts, events, and shops for review, and may optionally purchase a paid Featured Listing upgrade.
Accounts and accurate information
- You are responsible for keeping your account credentials confidential and for all activity under your account.
- You must provide accurate submission and contact information and keep it up to date.
- Listings must describe real, verifiable haunts, events, or physical brick-and-mortar locations. Online-only stores are not eligible for retail listings.
Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose, or to submit fraudulent, spam, or deliberately misleading listings;
- post content that infringes anyone's intellectual property, privacy, or other rights;
- post harassing, hateful, threatening, sexually explicit, or otherwise abusive content;
- interfere with the security or integrity of the Service, including probing, scanning, introducing malware, or circumventing technical limits;
- scrape, crawl, or bulk-extract listings or member data, or resell or redistribute the Service.
Your content
You retain ownership of the listings, photos, ratings, and comments you submit. You grant FrightSpot LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and promoting the Service. You confirm you have the rights to everything you upload, including photographs. If you believe content on FrightSpot infringes your rights, contact us and we will review and, where appropriate, remove it; repeat infringers lose access.
Moderation, suspension and termination
All submissions are reviewed before publication and we may decline, edit, hide, or remove any listing or user content at our discretion. We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.
Intellectual property
The Service itself — including its software, design, branding, icons, and documentation — is owned by FrightSpot LLC and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service. You may not reverse engineer or create derivative works from it.
Payments, billing and Featured Listings
Featured Listing is a one-time paid upgrade that adds a featured badge, priority placement, and an expanded photo gallery to an approved listing. The price shown at checkout is the price charged, in the currency displayed.
Our order process is conducted by Stripe. Stripe is the Merchant of Record for our orders and handles payment processing, tax, receipts, refunds, and billing support.
Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe's buyer terms. See our Refund Policy for how to request a refund. Featured placement applies only to listings that pass review; if a listing is rejected, the Featured fee is refunded in full.
Service availability and warranties
The Service is provided "as is". We do not guarantee uninterrupted or error-free operation, and listing details (dates, prices, addresses, hours) are supplied by third parties and may change without notice — always confirm with the venue before travelling. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, FrightSpot LLC is not liable for indirect, incidental, consequential, or special damages, including lost profits, lost data, or loss of goodwill. Our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
Indemnity
You agree to indemnify FrightSpot LLC against claims, damages, and costs arising from your content, your unlawful use of the Service, or your breach of these Terms.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the "last updated" date above, and continued use of the Service after a change means you accept the revised Terms.
Governing law and contact
These Terms are governed by the laws of the State of California, USA, and the courts located in California have exclusive jurisdiction over any dispute. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control.
